Terms of Service

1. Agreement to Terms

By accessing or using ListingsReady (“the Service”), operated by ListingsReady Pty Ltd (ABN to be inserted) (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ListingsReady is a marketplace platform connecting real estate agents with property photographers and stylists. The Service includes a website at listingsready.com.au and mobile applications for iOS and Android. We facilitate bookings, communications, and workflow management between users but are not a party to any agreement between agents and service providers.

3. User Accounts

To use the Service, you must create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to create an account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activity.

4. Subscriptions and Payment

The Service is offered on a subscription basis. All prices are in Australian Dollars (AUD) and include GST where applicable. Subscriptions begin with a 14-day free trial. After the trial, you will be charged according to your selected plan unless you cancel before the trial ends.

Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified via email before any price change takes effect.

5. User Conduct

You agree not to: use the Service for any unlawful purpose; impersonate another person or entity; upload harmful, offensive, or misleading content; interfere with or disrupt the Service; attempt to gain unauthorised access to other accounts or systems; scrape, copy, or reproduce the Service without permission.

6. Bookings and Transactions

ListingsReady facilitates connections between agents and service providers (photographers and stylists). We are not a party to any agreement, booking, or transaction between users. Pricing, cancellation policies, and terms of service between agents and providers are set by the individual provider.

We do not guarantee the quality, accuracy, or timeliness of any service provided by photographers or stylists on the platform. Disputes between users should be resolved directly between the parties involved.

7. Intellectual Property

The Service, including its design, features, content, and code, is owned by ListingsReady Pty Ltd and protected by Australian copyright law. Users retain ownership of content they upload (profile information, portfolio images, reviews). By uploading content, you grant us a non-exclusive licence to display it on the platform.

8. Limitation of Liability

To the maximum extent permitted by Australian law, ListingsReady Pty Ltd is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your account at any time for violation of these terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after deletion, after which it is permanently removed.

10. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
